We understand that clients sometimes simply want answers to find out exactly what happened to their loved ones. In certain circumstances the Procurator Fiscal will hold a Fatal Accident Enquiry in an effort to establish the facts. A Fatal Accident Enquiry is always held where there has been a death following an accident at work or where a death has occurred in custody. However the Fiscal also has a discretionary power to hold a Fatal Accident Enquiry in other circumstances. However, clients may also be entitled to compensation when the death of a loved one was caused by the negligence of someone else.
The Damages (Scotland) Act 2011 defines who can make a claim. Only relatives defined as “immediate family” can make a claim. This includes:
- A spouse or former spouse
- A civil partner or former civil partner
- A cohabitee
- A parent
- A child
- A sibling (brother or sister)
- Uncle or Aunt
Not only can individual family members make a claim for compensation but it is also possible for a claim to be advanced on behalf of the Deceased’s estate to recover expenses such as funeral costs and other financial losses. It is also possible to claim for the pain and distress the deceased suffered immediately prior to their death.
