A psychological injury or what is also known as a psychiatric injury can develop where a person has had a serious accident or has witnessed a traumatic event. For example a psychological injury can develop in several situations including following a road traffic accident, an accident at work or even after an incident of medical negligence.
Conditions such as anxiety, depression and post-traumatic stress disorder (PTSD) are commonly associated with psychological injury. According to the NHS symptoms can be immediate but they may take some time to manifest. These symptoms can include flashbacks, feeling restless, insomnia, feelings of guilt, anger and irritability. A claim for psychological injury can be made by both primary victims and secondary victims.
A primary victim is someone who has been directly involved in an accident and a secondary victim is someone who witnessed the death or injury of others but was not at risk of physical injury. To be eligible for compensation as a secondary victim you must be able prove on balance of probabilities that:
- You had a close tie of love and affection with the immediate victim (spouse, parent, child or other immediate loved one).
- You were sufficiently close in time and space to the shocking event. That generally means that you witnessed the incident unfold or came upon its “immediate aftermath”.
