Medical practitioners across Scotland are some of the finest in the world. However, sadly, on very rare occasions, the standard of medical care falls below the accepted standards and can result in serious injury or death. In these circumstances, it may be possible to pursue a medical negligence claim against the treatment provider which may be the NHS or a private provider.
Pursuing a medical negligence claim can be complex. An injured party must prove:
- Negligence – that a medical practitioner has acted in a way that no other medical practitioner would have acted; and
- Causation – that the negligent act resulted in injury
In order to succeed you must prove both parts. In order to do that it is necessary to obtain reports from expert witnesses. Walker Laird offers a variety of funding options in pursuing medical negligence claims which includes Legal Aid and, in certain circumstances, No Win No Fee.
A question that often arises when clients first make contact with us is how they complain to the NHS. The NHS recommend that complaints be made within 6 months of an incident but no later than 12 months. Full details can be found here.
