Following separation couples do, on occasion, reconcile. However, the majority of couples sadly divorce which is a traumatic life event. Walker Laird’s expert divorce lawyers in Paisley provide supportive advice to ensure the process runs as smoothly as possible.
To obtain a divorce in Scotland you must establish that the marriage has broken down irretrievably. The two most common types of divorce are when:
- Parties have been separated for 1 year and both parties agree that they wish to be divorced; or
- Parties have been separated for 2 years and only one party wishes to be divorced.
In either of these scenarios if there are no finances to be taken into consideration or any children under 16 then a divorce can be proceeded under the simplified procedure. This is the most straightforward and cheapest way to divorce. However, it’s still advised that you seek the expertise of a divorce lawyer to avoid any unnecessary issues arising and to ensure you know your rights.
However, if there are financial issues to be sorted out and/or children under the age of 16 then divorce would proceed under what’s known as ordinary procedure. This can be a lengthier and more complex legal process.
The other grounds upon which a court would be satisfied that the marriage has broken down irretrievably are:
- Unreasonable behaviour;
- Adultery
- Your spouse’s gender being reassigned
